Terms of Service

Welcome to Unsmoke (“Unsmoke”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of the Unsmoke mobile application, website, and related services (collectively, the “Services”). By creating an account or using the Services you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Who may use Unsmoke

You must be at least 18 years old or the age of majority in your jurisdiction.
You must have the legal power to enter a binding contract.
You agree to provide truthful, current information and keep it updated.

2. Health and safety notice

Unsmoke offers digital tools and educational content to support behaviour change. We are not a medical device, healthcare provider, or pharmacy. The Services do not diagnose, treat, or cure disease and should not replace advice from licensed clinicians. Any Information or Statistics or Details shown in the Application is purely for Motivational Purposes only. UnSmokeAi is not liable to any charge. Consult a doctor before starting a quit attempt, changing medications, or interpreting health metrics. Call emergency services immediately if you experience a medical emergency.

3. Accounts & security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must notify us immediately of unauthorised use or security breaches.
We may suspend or terminate your account if we believe you violated these Terms, engaged in fraud, or compromised the security of other users.

4. Acceptable use

You agree not to:

Share false, misleading, or malicious content.
Upload files or run code that disrupts, damages, or interferes with the Services.
Reverse engineer, decompile, or attempt to access the source code.
Use automated scripts or bots without our written permission.
Collect or harvest data about other users without consent.
Use the Services for unlawful, abusive, or discriminatory purposes.

5. Intellectual property

All content, software, designs, and branding in the Services are owned by Unsmoke or our licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services for your personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works without written consent.

6. User content

You retain ownership of the information you submit to the Services.
You grant Unsmoke a worldwide, non-exclusive, royalty-free licence to use, store, display, reproduce, and create derivative works from your content solely to operate, improve, and provide the Services.
You represent that you have the rights to submit the content and that it does not violate any third-party rights or laws.

7. Feedback

If you share comments, ideas, or suggestions (“Feedback”), you grant us the right to use the Feedback without restriction or compensation. Feedback is optional and helps us improve Unsmoke.

8. Beta features

We may label some features as “beta,” “pilot,” or “experimental.” These features are provided as-is, may change at any time, and may be discontinued without notice. You assume all risks associated with beta features.

9. Third-party services

The Services integrate third-party tools (for example, Google OAuth, Supabase, and generative AI providers). Your use of those services is governed by the providers’ own terms and privacy practices. We are not responsible for third-party services and integrations.

10. Subscription and fees

Some features may require payment. Prices, billing cycles, and refund policies will be presented at the point of purchase. Unless stated otherwise, fees are non-refundable. Taxes may apply. We reserve the right to change pricing with reasonable notice. Your subscription will automatically renew unless you cancel before the renewal date.

11. Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent allowed by law, Unsmoke disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, error-free, or secure operation.

12. Indemnification

You agree to indemnify and hold harmless Unsmoke and its affiliates from claims, damages, liabilities, and expenses (including legal fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.

13. Termination

You may stop using the Services at any time. We may suspend or terminate access with notice if you violate these Terms, pose a security risk, or misuse the Services. Upon termination, your licence ends and you must stop using the Services. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.

14. Changes to the Terms

We may update these Terms periodically. Material changes will be communicated via in-app notice or email. The “Effective date” reflects the latest revision. Continued use after changes constitutes acceptance of the updated Terms.
